Agreement to these terms
These Terms of Service govern your use of Restaurants Email Marketing, including its public guides, templates, and AI-assisted writing tools. By using the service, you agree to these terms. If you do not agree, please do not use the service.
Eligibility
You must be at least 18 years old and legally able to enter into these terms. If you use the service for a restaurant, company, or other organization, you confirm that you have authority to act on its behalf.
What the service provides
Restaurants Email Marketing provides educational resources, reusable templates, and AI-assisted writing tools. These materials are designed to help restaurant operators prepare and review marketing drafts.
The service does not send email campaigns, manage mailing lists, store subscriber databases, process unsubscribe requests, provide marketing automation, or replace an email service provider.
Free AI usage
AI-assisted features may be offered with a limited number of free uses. Usage limits, reset schedules, available features, and access conditions may change as the service develops. We do not promise that any feature will remain free or available indefinitely.
Your input and responsibilities
You are responsible for the information and instructions you submit. You must have the rights and permissions needed to use that material and must not submit content that is unlawful, infringing, deceptive, or harmful.
Do not submit customer lists, payment information, passwords, health information, confidential information, or other sensitive personal information. The service is not designed to receive or manage that material.
AI-generated content
AI-generated content is provided as a draft. It may be inaccurate, incomplete, unsuitable, or similar to content generated for other users. We do not guarantee that any output is unique, error-free, or appropriate for a particular campaign.
You must review and edit every draft before using it. You are responsible for verifying prices, dates, addresses, menu items, availability, offer conditions, reservation details, and all other factual claims.
Your marketing responsibilities
You are responsible for your email campaigns and for complying with laws, regulations, platform rules, consent requirements, sender identification requirements, and unsubscribe obligations that apply to you and your audience.
The service provides general writing and educational assistance, not legal, regulatory, financial, or professional advice. It does not guarantee that a draft or campaign will be legally compliant or achieve a particular result.
Acceptable use
You may not use the service to:
- Send spam, phishing messages, or deceptive promotions.
- Impersonate another person or misrepresent a business.
- Violate privacy, intellectual property, or other legal rights.
- Create or distribute unlawful, abusive, or harmful material.
- Circumvent usage limits or interfere with service security.
- Scrape, resell, or republish a substantial portion of the website or template library as a competing product.
Content and permitted use
You retain any rights you have in the information you submit. You give us permission to process that information only as needed to provide, secure, and maintain the requested service.
You may copy and adapt the public email templates for your own restaurant or business campaigns. The website's branding, design, software, original editorial content, and collection of materials remain protected by applicable intellectual property laws. No rights are granted except as expressly stated in these terms.
Third-party services
Some features depend on third-party services. Their availability, outputs, and practices are outside our control and may be governed by their own terms and policies. We are not responsible for third-party websites or services linked from this website.
Availability and changes
We may change, limit, suspend, or discontinue any part of the service at any time. We may also restrict access when reasonably necessary to protect the service, enforce these terms, comply with law, or address misuse. We do not guarantee uninterrupted or error-free availability.
Disclaimers
To the fullest extent permitted by law, the service and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant the accuracy, suitability, uniqueness, compliance, availability, or performance of any content or feature.
Limitation of liability
To the fullest extent permitted by law, Restaurants Email Marketing and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of or inability to use the service. Nothing in these terms excludes liability that cannot lawfully be excluded.
Applicable law
Your use of the service must comply with all laws that apply to you. These terms do not limit consumer or other rights that cannot be waived under applicable law. Any dispute will be handled by a court or other forum with lawful jurisdiction over the parties and the dispute.
Changes to these terms
We may update these terms as the service changes. The revised terms will be posted on this page with a new revision date. Continued use after an update means you accept the revised terms to the extent permitted by law.
